Terms and conditions

DEFENITIONS

In these terms and conditions:

• Oser Couture: the business located at Strijkviertel 9–22, 3454 PG Utrecht, The Netherlands, registered with the Dutch Chamber of Commerce under number 97282340, VAT number NL005260639B22.
• Consumer: any natural person not acting in the course of a profession or business who enters into a distance contract with Oser Couture.
• Distance contract: an agreement concluded between Oser Couture and a consumer through an organized system for distance selling without physical presence.

APPLICABILITY

These general terms and conditions apply to all offers from Oser Couture and to all distance contracts concluded via the website www.wp.31-70-68-23.plesk.page.

By placing an order, the customer agrees to these terms. Deviations are valid only if confirmed in writing.

OFFER AND AGREEMENT

The product descriptions are accurate and complete. Obvious mistakes do not bind Oser Couture. The contract is concluded upon confirmation of the order and receipt of payment. Oser Couture will confirm receipt of the order electronically.

PRICES AND PAYMENT

1. All prices include VAT and exclude shipping costs unless otherwise stated.
2. Payment must be made through the available payment methods prior to delivery.
3. If payment is not received, Oser Couture may cancel the order.

DELIVERY

1. Products are delivered to the address provided by the customer.
2. Orders are shipped within 1–3 business days (NL), unless otherwise agreed.
   • Europe: approx. 3–7 business days
   • Worldwide: approx. 7–14 business days
3. Delivery times are indicative. Delays do not entitle customers to compensation or cancellation unless unreasonable.

RIGHT OF WITHDRAWAL (CONSUMER)

1. The consumer has the right to withdraw from the contract within 14 days of receiving the product.
2. During the reflection period, the consumer shall handle the product and packaging with care.
3. Returned products must be in original condition, with ribbon unbroken and clothes are unworn, with all labels attached.
4. Return shipping costs are the responsibility of the consumer.
5. Upon valid withdrawal, the purchase price including shipping will be refunded within 14 days of receipt.
6. Exception: custom–made or hygiene–sealed items that have been opened cannot be returned.
7. Sale items and discounted items are non-refundable and can only be exchanged for another size or item.
   

COMPLAINTS AND WARRANTY

1. Complaints must be reported within a reasonable time (max. 2 months after discovery).
2. Oser Couture will respond within 5 business days.
3. Legal warranty applies: the product must meet the reasonable expectations based on the agreement.

LIABILITY

1. Oser Couture is not liable for damages resulting from misuse or after–delivery defects.
2. Liability is limited to the value of the order, unless due to intent or gross negligence.

FORCE MAJEURE

Oser Couture is not liable for failure to fulfill obligations due to force majeure (e.g. disruptions, illness, transport issues).

INTELLECTUAL PROPERTY

All intellectual property rights to designs, images, products, and website content belong to Oser Couture. Use without prior written consent is prohibited.

PRIVACY

APPLICABLE LAW AND JURISDICTION

1. Dutch law applies exclusively to all agreements.
2. Disputes are submitted to the competent court in the district of Midden-Nederland, unless mandatory law dictates otherwise.
