Algemene Voorwaarden – Oser Couture
1. Definities
In deze algemene voorwaarden wordt verstaan onder:
• Oser Couture: de eenmanszaak/onderneming gevestigd aan Strijkviertel 9-22, 3454
PG te Utrecht, ingeschreven bij de Kamer van Koophandel onder nummer 97282340,
BTW-nummer NL005260639B22.
• Consument: een natuurlijk persoon die niet handelt in de uitoefening van een beroep
of bedrijf en een overeenkomst op afstand aangaat met Oser Couture.
• Overeenkomst op afstand: een overeenkomst gesloten tussen Oser Couture en een
consument in het kader van een georganiseerd systeem voor verkoop op afstand,
zonder gelijktijdige persoonlijke aanwezigheid.
2. Toepasselijkheid
Deze algemene voorwaarden zijn van toepassing op elk aanbod van Oser Couture en op alle
tot stand gekomen overeenkomsten op afstand via de website www.wp.31-70-68-23.plesk.page.
Door het plaatsen van een bestelling accepteert de klant deze voorwaarden. Afwijkingen zijn
alleen geldig indien schriftelijk overeengekomen.

4. Aanbod en totstandkoming overeenkomst
1. 2. 3. Het aanbod bevat een volledige en nauwkeurige omschrijving van de aangeboden
producten. Kennelijke vergissingen of fouten in het aanbod binden Oser Couture niet.
De overeenkomst komt tot stand op het moment van aanvaarding door de klant via het
bestelproces van de webshop en nadat betaling is ontvangen.
Oser Couture bevestigt de ontvangst van de bestelling elektronisch.
5. Prijzen en betaling
1. Alle vermelde prijzen zijn inclusief btw en exclusief verzendkosten (tenzij anders
2. aangegeven).
Betaling dient te geschieden via de beschikbare betaalmethoden op de website,
voorafgaand aan levering.3. Indien de betaling niet wordt ontvangen, heeft Oser Couture het recht de bestelling te
annuleren.
6. Levering
1. 2. 3. Levering vindt plaats op het door de klant opgegeven adres.
Oser Couture spant zich in bestellingen binnen 1-3 werkdagen te verzenden (NL),
tenzij anders overeengekomen.
o Binnen Europa: ca. 3–7 werkdagen
o Buiten Europa: ca. 7–14 werkdagen
Levertermijnen zijn indicatief. Overschrijding van een termijn geeft geen recht op
schadevergoeding of ontbinding, tenzij de vertraging onredelijk is.
7. Herroepingsrecht (consument)
1. 2. 3. 4. 5. 6. De consument heeft het recht de overeenkomst zonder opgave van redenen te
ontbinden binnen 14 dagen na ontvangst van het product (herroepingsrecht).
Tijdens de bedenktijd dient de consument zorgvuldig om te gaan met het product en
de verpakking.
Bij herroeping dient het product binnen 14 dagen na melding te worden teruggestuurd,
in originele staat, ongedragen en met labels.
De kosten voor retourzending zijn voor rekening van de consument.
Oser Couture zal bij een geldige herroeping het volledige aankoopbedrag inclusief
verzendkosten binnen 14 dagen terugbetalen, mits het product retour ontvangen is.
Uitzondering: producten die gepersonaliseerd zijn of hygiënisch verzegeld geleverd en
geopend zijn, kunnen niet worden geretourneerd (art. 6:230p BW).
8. Klachten en garantie
1. 2. 3. Klachten over een product of dienstverlening dienen binnen een redelijke termijn
(uiterlijk 2 maanden na ontdekking) per e-mail gemeld te worden.
Oser Couture zal binnen 5 werkdagen inhoudelijk reageren.
Op geleverde producten is de wettelijke garantie van toepassing (conformiteitseis, art.
7:17 BW).
9. Aansprakelijkheid
1. 2. Oser Couture is niet aansprakelijk voor schade als gevolg van verkeerd gebruik van
producten of gebreken die zijn ontstaan na levering.
Aansprakelijkheid is beperkt tot de waarde van het bestelde product, tenzij sprake is
van opzet of grove nalatigheid.
10. Overmacht
Oser Couture is niet gehouden tot nakoming van enige verplichting indien zij daartoe
verhinderd is als gevolg van overmacht (zoals storingen, ziekte, overheidsmaatregelen of
vervoersbelemmeringen).
11. Intellectuele eigendomAlle rechten met betrekking tot de website, ontwerpen, beeldmateriaal en producten (zoals
merken, auteursrechten en vormgeving) behoren toe aan Oser Couture. Gebruik, reproductie
of publicatie zonder voorafgaande schriftelijke toestemming is niet toegestaan.
12. Privacy
Wij verwerken persoonsgegevens conform de Algemene Verordening Gegevensbescherming
(AVG). Zie ons privacybeleid voor meer informatie.
13. Toepasselijk recht en bevoegde rechter
1. 2. Op alle overeenkomsten tussen Oser Couture en de klant is uitsluitend Nederlands
recht van toepassing.
Geschillen worden voorgelegd aan de bevoegde rechter in het arrondissement Midden-
Nederland, tenzij dwingend recht anders voorschrijft (zoals voor consumenten).

• Consumer: any natural person not acting in the course of a profession or business
who enters into a distance contract with Oser Couture.
• Distance contract: an agreement concluded between Oser Couture and a consumer
through an organized system for distance selling without physical presence.
2. Applicability
These general terms and conditions apply to all offers from Oser Couture and to all distance
contracts concluded via the website www.wp.31-70-68-23.plesk.page.
By placing an order, the customer agrees to these terms. Deviations are valid only if
confirmed in writing.

5. Prices and Payment

Payment must be made through the available payment methods prior to delivery.
If payment is not received, Oser Couture may cancel the order.
6. Delivery

Orders are shipped within 1–3 business days (NL), unless otherwise agreed.
o Europe: approx. 3–7 business days
o Worldwide: approx. 7–14 business days
Delivery times are indicative. Delays do not entitle customers to compensation or
cancellation unless unreasonable.
7. Right of Withdrawal (Consumer)
1. The consumer has the right to withdraw from the contract within 14 days of receiving

During the reflection period, the consumer shall handle the product and packaging
with care.
Returned products must be in original condition, unworn, with all labels attached.
Return shipping costs are the responsibility of the consumer.
Upon valid withdrawal, the purchase price including shipping will be refunded within
14 days of receipt.
Exception: custom-made or hygiene-sealed items that have been opened cannot be
returned.
8. Complaints and Warranty
1. Complaints must be reported within a reasonable time (max. 2 months after

Oser Couture will respond within 5 business days.
Legal warranty applies: the product must meet the reasonable expectations based on
the agreement.
9. Liability
1. 2. Oser Couture is not liable for damages resulting from misuse or after-delivery defects.
Liability is limited to the value of the order, unless due to intent or gross negligence.
10. Force MajeureOser Couture is not liable for failure to fulfill obligations due to force majeure (e.g.
disruptions, illness, transport issues).
11. Intellectual Property
All intellectual property rights to designs, images, products, and website content belong to
Oser Couture. Use without prior written consent is prohibited.
12. Privacy
Personal data is processed in accordance with the General Data Protection Regulation

13. Applicable Law and Jurisdiction
1. 2. Dutch law applies exclusively to all agreements.
Disputes are submitted to the competent court in the district of Midden-Nederland,
unless mandatory law dictates otherwise.
